ARISIFY TERMS OF SERVICE & PRIVACY POLICY
Welcome to Aris. This document combines our Terms of Service ("Terms") and Privacy Policy. Please read it carefully before installing, activating, or using any software applications, widgets, APIs, or related services (collectively, the "Apps" or "Services") developed and published by Aris ("we," "us," "our," or "Company"), accessible at arisify.io and via the Shopify App Store.
By installing, accessing, or using our Apps (including Aris Product Options, Aris Bundle, and Aris Swatches & Variant Images), you ("Merchant," "Store Owner," "User," or "you") acknowledge that you have read, understood, and agree to be legally bound by all terms, conditions, data practices, disclaimers, and limitations contained herein. If you do not agree, you must immediately uninstall and discontinue all use of our Apps.

PART I: TERMS OF SERVICE
1. Description of Service & Operational Scope
• Scope of Applications: Aris provides SaaS solutions to enhance storefront customization, dynamic product options, variant image swatches, bundle offers, and pricing logic on Shopify.
• Merchant Responsibility: You retain exclusive control over your store settings, themes, pricing configurations, checkout rules, and product catalogs.
2. Subscription, Billing, and Refunds
• Billing: All fees, upgrades, downgrades, and billing cycles are managed exclusively through Shopify's Billing API.
• Renewal: Subscriptions renew automatically (every 30 days or annually) unless uninstalled prior to the billing cycle end date.
• Refunds: Subscription fees are non-refundable once a cycle begins. Goodwill refunds are at the sole discretion of Aris support.
3. Merchant Obligations & Pre-Deployment Testing
• Testing Duty: Merchants are strictly required to thoroughly test the full shopping workflow on an unpublished theme before publishing live.
• Operational Oversight: You must monitor storefront order flows and checkout completion rates. If an error is suspected, immediately notify Aris (help@arisify.io) and disable the widget.
• Theme Modifications: Aris is not liable for disruptions resulting from edits made to your store's Liquid templates, CSS, third-party JavaScript, or other apps.
4. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE". ARIS DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE ERROR-FREE, UNINTERRUPTED, OR ACHIEVE SPECIFIC REVENUE GOALS.
5. Exclusion of Consequential Damages & Liability Cap
• No Consequential Damages: ARIS SHALL NOT BE LIABLE FOR ANY LOST SALES, MISSED ORDERS, ABANDONED CARTS, LOST REVENUE, BUSINESS INTERRUPTION, OR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
• Liability Cap: ARIS'S TOTAL AGGREGATE LIABILITY UNDER ANY CIRCUMSTANCES SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU FOR THE APPLICABLE APP DURING THE TIME OF USE.
6. App Store Reviews & Conduct
We welcome genuine reviews. However, merchants are strictly prohibited from using reviews, ratings, or threats of 1-star reviews to extort financial compensation or payouts. Any such attempts will result in immediate termination of support, license revocation, and reporting to Shopify Partner Trust & Safety.
7. Indemnification
You agree to defend and indemnify Aris from any claims, liabilities, losses, or legal expenses arising from your breach of these Terms, disputes with your end-customers, or violations of applicable laws.
8. Termination
You may terminate this Agreement by uninstalling the Apps. Aris may terminate or suspend service immediately for breaches of these Terms or unlawful behavior. Sections 4, 5, 6, 7, and 10 survive termination.

PART II: PRIVACY POLICY & DATA PROTECTION
We are committed to protecting personal data in compliance with global frameworks (GDPR, CCPA/CPRA, PIPEDA, LGPD, and Shopify's Data Processing requirements).
1. Roles Under Data Protection Laws
• Merchant Account Data (Aris as Data Controller): We control data provided by store owners (email, names, billing records) necessary for app licensing.
• Store Shopper Data (Aris as Data Processor): You remain the Data Controller for shoppers interacting with our widgets. We act solely as a Processor executing scripts and formatting line items.
2. Data We Collect and Process
• Merchant Info: Store name, .myshopify.com domain, admin email, billing status, and locale.
• App Configurations: Custom options, styling parameters, and pricing rules.
• Shopper Inputs & Uploads: Customer selections, typed text, and securely stored uploaded files (via AWS S3) strictly for order fulfillment.
• Cart & Technical Data: Temporary cart tokens, order IDs, IP addresses, browser info, and error telemetry.
• Excluded Data: We DO NOT collect shopper credit card numbers or full financial credentials.
3. Purpose of Processing
We process data for contractual necessity (delivering core functionality), legitimate business interests (security, optimization), customer support, and legal compliance.
4. Sub-processors
We do not sell or rent personal data. Data is shared only with vetted sub-processors under strict Data Processing Agreements:
• Cloud/Database: AWS / Google Cloud Platform
• Edge/Security: Cloudflare, Inc.
• Platform: Shopify
5. Shopify Mandatory Compliance Webhooks
• customers/data_request: We export stored option logs/files upon customer request.
• customers/redact: We permanently delete/anonymize a shopper's personal identifiers within 30 days of a request.
• shop/redact: Within 48 hours of uninstallation, Shopify triggers this webhook. We permanently purge all store settings and records within 30 days.
6. Security Safeguards & Data Retention
All network traffic is encrypted via TLS 1.3, and data at rest via AES-256. Access is restricted via strict RBAC and MFA. Customer uploads are retained strictly for fulfillment and purged automatically. All records are destroyed within 30 days post-uninstallation.
7. Data Subject Rights
Merchants and qualifying individuals maintain rights to Access, Portability, Rectification, and Erasure. Merchants may email help@arisify.io. End-customers must contact the Merchant directly. Our services are not directed at children under 16.

PART III: GENERAL PROVISIONS
1. Governing Law & Dispute Resolution
These Terms and Privacy Policy shall be governed by the laws of Vietnam. Disputes shall be addressed through good-faith discussions. If unresolved, exclusive jurisdiction lies with the competent courts of Hanoi, Vietnam.
